1. Scope and contracting party

These Terms and Conditions govern the use of the WurzelLotse app and its companion website. The provider is Silvio Lindstedt und Maik Gräfendorf GbR, Pappelweg 27, 39576 Stendal, Germany ([email protected], "we"). These Terms apply to consumers.

2. Description of the service

WurzelLotse is a garden calendar for beginners. The app helps you set up your garden, get an initial read on your plants, and receive care guidance based on that. This includes AI-assisted features, e.g. for assessing plant photos and generating care plan suggestions. These suggestions are hints, not active tasks — a task is only created once you explicitly accept a suggestion. The scope and limits of these AI features are described further in Section 6.

WurzelLotse is available in a free basic version and a paid Premium version (Section 5).

3. Formation of contract and user account

You can start using WurzelLotse without registration, via an anonymous account; a usage agreement under these Terms is formed once you install and use the app. Cloud backup and subscribing to Premium do not require a separate sign-up form with a password — your account is tied to your device. Using the app requires that you have legal capacity to contract.

4. Acceptable use

When using WurzelLotse, you agree to

• not use the app in an automated, abusive way, or in a way that impairs the service, other users, or third parties,
• not upload or submit content you don't hold rights to, or that violates applicable law,
• not circumvent technical safeguards (e.g. rate limits).

In case of violations, we may restrict individual features or suspend the account.

5. Premium subscription and payment

Premium is available as a monthly (€2.99) or yearly (€19.99) subscription and expands, among other things, the number of usable gardens and care objects, the monthly quota for photo scans and AI care plan generations, and adds automatic cloud backup. Premium follows a permanent fair-use model: it offers generous usage limits that won't be noticeable in normal private use, rather than unlimited use. The app shows the currently applicable quotas directly at the relevant feature.

Purchase, billing, renewal, cancellation, and refunds for the subscription are handled entirely through the Apple App Store or Google Play, with whom you enter into the payment agreement. In addition to these Terms, the respective terms of Apple or Google apply, particularly regarding the right of withdrawal, automatic renewal, and refunds. You can cancel your subscription at any time directly in the settings of the respective store; cancellation takes effect at the end of the current billing period.

6. Liability and expectations notice

The care guidance and care plan suggestions provided by WurzelLotse are AI-assisted gardening hints meant for orientation. They are created with care, but may still, in individual cases, be inaccurate, incomplete, or not suited to your specific situation — for instance because local conditions such as location, soil, microclimate, or the actual state of a plant differ from the app's assumptions. Photo-based plant identification may likewise misjudge a plant or only produce an uncertain estimate.

You remain responsible for implementing care guidance and for checking whether it fits your situation. In unclear cases, for seriously damaged plants, or in situations with potential risk (e.g. to people, pets, or larger plantings), we recommend seeking additional expert advice, for example from a garden centre, a plant protection authority, or a comparable professional source.

7. Availability and changes to the offering

We aim to keep WurzelLotse continuously available but cannot guarantee uninterrupted availability, for example during maintenance or outages of upstream services (e.g. AI or weather data providers). We may adjust WurzelLotse's feature scope with reasonable advance notice, provided the app's core value is not materially impaired.

8. Termination and account deletion

You can stop using WurzelLotse at any time by deleting the app or selecting "Delete all data" in Settings. Your data will then be deleted immediately and permanently. An existing Premium subscription is not automatically ended by this — cancel it separately in the respective App Store or on Google Play (Section 5), as that is where the payment agreement exists.

9. Changes to these Terms

We may amend these Terms, for example due to legal changes or further development of WurzelLotse. We will inform you of material changes in the app or by email, where a contact method is available to us, with reasonable notice before they take effect.

10. Final provisions

These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident outside Germany, mandatory consumer protection provisions of your country of residence remain unaffected. Should any provision of these Terms be invalid, the validity of the remaining provisions is not affected.
